ABA PREVIEW OF SUPREME COURT DECISION INCLUDES MSU LAW PROFESSOR’S ARTICLE

Professor Halloran’s Article on Boulware Published

East Lansing, MI – Michigan State University College of Law Clinical Professor Michele LaForest Halloran’s article “Does a Taxpayer Have the Burden of Showing Intent to Divert Corporate Funds as Return of Capital?,” which is based on the tax case, Boulware v United States, has been published in the American Bar Association’s (ABA) Supreme Court Preview Magazine.

Boulware is being argued before the U.S. Supreme Court today, and the Court will decide on the proper tax treatment of an individual shareholder when the shareholder diverts corporate funds for personal use.

The ABA publishes a Preview of the month’s Supreme Court decisions in order to provide the cases at a glance. Professor Halloran lays out Boulware in her article and provides insight into and analysis of the issue and facts of the case.

Professor Halloran is a clinical professor, director of clinical programs, and director of the MSU Law Tax Clinic at the Law College.
